These Terms & Conditions ("Terms") govern your use of FiveStar, a review-request messaging service operated by Auto Flow Developers ("we," "us," or "our"). By accessing our website, creating an account, or using FiveStar, you agree to these Terms.
1. Description of Service
FiveStar provides automated review-request messaging services for home service businesses and similar companies. The service allows participating businesses to send SMS messages to their customers requesting reviews on platforms such as Google, Yelp, or other review sites.
FiveStar acts as a technology platform. Participating businesses are responsible for their customer relationships, the accuracy of customer contact information they provide, and obtaining any consent required before sending messages to their customers.
2. SMS Program Terms
- Message frequency varies. The number of messages you receive depends on your interactions with participating businesses and the settings chosen by each business. You may receive one or more messages per completed service or transaction.
- Message and data rates may apply. Standard carrier messaging and data charges may apply. Check with your mobile carrier for details.
- STOP keyword. Reply STOP to any message to cancel SMS messages from that program. You will receive a one-time confirmation message. After opting out, you will not receive further review-request messages unless you re-subscribe or provide new consent.
- HELP keyword. Reply HELP to any message for assistance, or contact us at autoflowdevelopers@gmail.com or 832-727-2600.
- Supported carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network and policies.
3. Business Account Terms
If you are a business using FiveStar, you agree to:
- Provide accurate account and billing information
- Obtain all legally required consent from customers before submitting their phone numbers for messaging
- Use FiveStar only for lawful, legitimate review-request purposes
- Not use the service to send spam, harassing, deceptive, or prohibited content
- Comply with applicable laws, including TCPA, CTIA guidelines, and carrier requirements for SMS programs
4. Service Limitations
FiveStar is provided on an "as is" and "as available" basis. We do not guarantee that:
- Every message will be delivered successfully or in a specific timeframe
- Customers will leave reviews after receiving a message
- The service will be uninterrupted, error-free, or available at all times
- Review platforms will accept, display, or retain reviews submitted by customers
We may modify, suspend, or discontinue any part of the service with reasonable notice where practicable. We are not responsible for delays or failures caused by third-party carriers, review platforms, internet outages, or factors outside our reasonable control.
5. Fees and Payment
Business customers agree to pay applicable fees as described during signup or in a separate agreement. Failure to pay may result in suspension or termination of service.
6. Intellectual Property
FiveStar, its branding, software, and website content are owned by Auto Flow Developers and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the service without our written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Auto Flow Developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FiveStar. Our total liability for any claim related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
8. Indemnification
Business customers agree to indemnify and hold harmless Auto Flow Developers from claims, damages, and expenses arising from their use of the service, including claims related to messages sent to their customers without proper consent or in violation of applicable law.
9. Termination
We may suspend or terminate access to FiveStar if you violate these Terms or use the service in a way that poses legal or operational risk. You may stop using the service at any time. Sections that by their nature should survive termination will remain in effect.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of FiveStar after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
